The DUII charge against Ducks defensive tackle Isaac Remington will be dropped, officials said today.
Remington was stopped on October 12 near the University of Oregon campus and passed a breathalyzer test with a blood alcohol level of .06 — below Oregon’s legal limit of .08. Oregon law allows officers to arrest a person for DUII regardless of their BAC if the officer feels they were impaired.
City Prosecutor Dan Barkovic told The Register-Guard that authorities could not “prove beyond a reasonable doubt” that Remington was impaired and will not file charges against him in Eugene Municipal Court.
Head coach Chip Kelly initially suspended Remington indefinitely after the incident but the Ducks announced today that the suspension would be lifted.
