A ruling on whether the University must undergo a more rigorous public mitigation process for the basketball arena was expected to be submitted to city planners late Tuesday night.
Members of the Fairmount Neighborhood Association, the neighborhood where the arena is set to be built, appealed a city decision that said the University doesn’t need a conditional use permit in order to proceed with construction.
A conditional use permit would allow nearby residents to have more say in the development’s appearance, size and parking requirements.
City Planning Director Lisa Gardner ruled that the arena is classified as “University or College” use, rather than an “Arena, Indoor” use, in City land use laws. That classification, which the Fairmount neighbors dispute, allows the University to build whatever it chooses at its own discretion.
Hearings Official Anne Corcoran Briggs heard the neighborhood association’s appeal at a May 7 hearing.
Briggs set herself a June 3 deadline to issue the ruling, but she said on Tuesday that her decision wouldn’t be submitted to City planners until late Tuesday night.
