COMMISSION
15% commission available to locally owned and operated agencies doing business ONLY in Lane County. All other rates are net.
ADVERTISING POLICIES
A. The Oregon Daily Emerald (ODE) reserves the right to edit, revise, or reject any advertising at any time.
B. Prepayment of an advertisement does not guarantee publication, as all advertising copy is subject to review in accordance with ODE standards of acceptance.
C. Advertiser shall notify the ODE of any error in time for correction before the second insertion. The ODE’s liability for error shall not exceed that portion of the entire cost of such advertisement as the space occupied by the error. Alternatively, upon advertiser’s request, ODE will consider running corrective advertising for any portion of the first insertion of advertising which has been rendered valueless by the ODE’s error. In order to obtain a “make-good” for any advertisement, the ODE must be notified within 5 working days after publication of the advertisement in question.
D. Except as provided above, the ODE shall be under no liability for loss to advertiser as a result of the publisher’s error or omission in advertising copy, failure to publish or to distribute all or any portion of an issue for which an advertisement
has been accepted.
E. The advertiser assumes full liability for their adv
ertisements and agrees to hold the ODE harmless for the content of all advertisements authorized for publication and any claims that arise therefrom that may be made against the ODE.
F. ODE will not be bound by any verbal agreements, promises, waivers, understandings or conditions that are not contained in this rate card or in a signed contract.
G. Advertising must be paid for at the time of placement until credit has been established. New businesses may apply for credit one year after opening. MC/VISA/AMEX/DISC are gladly accepted.
H. Advertising agencies acting on behalf of retail advertisers are agents for the
advertisers unless specifically accepted as principals by the ODE in writing.
I. The ODE reserves the right to insert the word “advertisement” in any advertising. Advertising inserts simulating editorial style must carry the identification “This entire supplement is paid advertising” at the top of the cover page and on each
succeeding page.
J. Advertisers, by having an advertisement printed in the ODE, are purchasing space and circulation only. All property rights, including any copyright interest, to any advertisement produced for the advertiser by the ODE, using artwork and typography furnished or arranged for by the ODE, shall be property of the ODE. No such ad or any part thereof may be reproduced or assigned without prior written consent of the ODE.
K. Neither party to this agreement shall be held liable for failure to perform as the result of fire, flood, strike, accident, acts of nature, or other reasons beyond their control. Under such circumstances, either party shall have the right to terminate this agreement without penalty. However, nothing in this paragraph shall excuse advertiser from its obligation to pay for advertising published by the ODE.
L. NOT ACCEPTED: Mail-order ads (unless a product sample is supplied for review prior to publication); term paper sales and editorial writing / research writing; adoption ads; airline ticket sale ads by anyone other than authorized agents.
